Disneyland hotel workers began a water-only fast this week to protest what they describe as life-threatening safety issues on the job.&lt;br /&gt;&lt;br /&gt;More than 2,000 bellmen, dishwashers, room attendants, and cooks at the Grand Californian Hotel say new work requirements have led to serious health problems among workers, including heart attack, stroke and musculoskeletal injuries.&lt;br /&gt;&lt;br /&gt;Narciso Guevara, a houseman at the Grand Californian Hotel, who is particpating int he fast, said: "We’re fighting for our health. Interesting stats published on &lt;a href="http://www.healthandsafetyprofessional.co.uk/"&gt;http://www.healthandsafetyprofessional.co.uk/&lt;/a&gt; today have revealed that workers are sick of Mondays, with one in three sick days taking place on the first day of the week. Lorna Watts, 26, told the BBC: "I asked why I couldn't borrow a pair of scissors and she said, 'they are sharp, you might stab me'.&lt;br /&gt;&lt;br /&gt;"I then asked to borrow a guillotine to cut up my leaflets but she refused again - because she said I could hit her over the head with it!"&lt;br /&gt;&lt;br /&gt;Lorna added: "It's absurd - there are plenty of heavy books I could have hit her with if I wanted to!"&lt;br /&gt;&lt;br /&gt;A spokeswoman for the HSE said there was no policy in place on lending sharp implements.&lt;br /&gt;"People know their own workplaces and must carry out their own risk assessments", she said.&lt;br /&gt;"But we do ask workplaces to take a common sense approach. yesterday.&lt;br /&gt;&lt;br /&gt;Judith Hackitt (Chair of the HSE), James Purnell (Secretary of State for Work and Pensions), Brendan Barber (TUC General Secretary) and representatives from the LGA and EEF were all in attendance, but apart from the rather attractively-designed literature, there wasn't much to report on.&lt;br /&gt;&lt;br /&gt;&lt;a href="http://www.healthandsafetyprofessional.co.uk/file/7ceb2b974dea4eb9e688e5effdad4e38/hse-launches-new-strategy-consultation.html"&gt;A previous article by HSW&lt;/a&gt; HSP user Judy Joinston is in two minds about this. "Whilst, yes, reading the names, ages and circumstances of their deaths makes you think, but what about Data Protection? I'd feel dreadful if my loved one died at work (obviously), even more so if I found their name on a public web site without my permission. Winds of up to 112mph carried us along the roads, which we had to walk in to avoid the falling roof tiles from buildings to the pavements.&lt;br /&gt;&lt;br /&gt;&lt;br /&gt;Authorities in Spain reported at least 12 deaths linked to Saturday's storm, including four children crushed as a sports facility buckled in high winds in Barcelona.&lt;br /&gt;&lt;br /&gt;&lt;br /&gt;We witnessed sand storms, walls collapsing, structures swaying - I tried to take pictures of electrical wires literally hanging at shoulder level on a residential street - although my photographic skills leave a lot to be desired. A customer (and a rather thuggish and scary-looking customer at that) was verbally abusing the guard in an extremely aggressive manner while everyone just stood and watched. I alerted another guard at the other side of the store who approached to deal with the situation and he subsequently diffused it. But it got me thinking ... why should employees have to deal with abuse such as what I witnessed today? These kinds of situations lead to stress and time off work, which isn’t good for the worker or the employer.&lt;br /&gt;&lt;br /&gt;What do you think? Having not even been aware that we are entitled to this after three years' service, I went along not really expecting much.&lt;br /&gt;&lt;br /&gt;However, I was very surprised - I had various tests including stress, posture, glucose, antioxidant levels, cholesteral etc etc and am pleased to say I am relatively healthy. But it got me thinking. The benefit to my employer of paying for us to have this health check is enormous - ever since the tests I have thought much more about my health, and the impact it has on my job. However, I am really not the sort of person who would rise at such a ludicrous time - election or no election, I like my sleep. The reason for my early awakening was to get the first train to Birmingham to attend the 2nd annual HSW/IIRSM conference.&lt;br /&gt;&lt;br /&gt;It was an informative, enjoyable day - most of the speakers had obviously attended a comedy course as the jokes came thick and fast. But there were serious points too - namely defence lawyer Paul Burnley of DLA Piper's talk on corporate manslaughter investigations. I just thought I'd share it with you.&lt;br /&gt;&lt;br /&gt;The ambulance in the valley&lt;br /&gt;&lt;br /&gt;'Twas a dangerous cliff, as they freely confessed,&lt;br /&gt;Though to walk near its crest was so pleasant;&lt;br /&gt;But over its terrible edge there had slipped&lt;br /&gt;A duke and full many a peasant.&lt;br /&gt;So the people said something would have to be done,&lt;br /&gt;But their projects did not at all tally;&lt;br /&gt;Some said, "Put a fence 'round the edge of the cliff,"&lt;br /&gt;Some, "An ambulance down in the valley."&lt;br /&gt;&lt;br /&gt;But the cry for the ambulance carried the day,&lt;br /&gt;For it spread through the neighbouring city;&lt;br /&gt;A fence may be useful or not, it is true,&lt;br /&gt;But each heart became full of pity&lt;br /&gt;For those who slipped over the dangerous cliff;&lt;br /&gt;And the dwellers in highway and alley&lt;br /&gt;Gave pounds and gave pence, not to put up a fence,&lt;br /&gt;But an ambulance down in the valley.&lt;br /&gt;&lt;br /&gt;"For the cliff is all right, if you’re careful," they said,&lt;br /&gt;"And, if folks ever slip and are dropping,&lt;br /&gt;It isn't the slipping that hurts them so much&lt;br /&gt;As the shock down below when they're stopping."&lt;br /&gt;So day after day, as these mishaps occurred,&lt;br /&gt;Quick forth would those rescuers sally&lt;br /&gt;To pick up the victims who fell off the cliff,&lt;br /&gt;With their ambulance down in the valley.&lt;br /&gt;&lt;br /&gt;Then an old sage remarked: "It's a marvel to me&lt;br /&gt;That people give far more attention&lt;br /&gt;To repairing results than to stopping the cause,&lt;br /&gt;When they'd much better aim at prevention.&lt;br /&gt;Let us stop at its source all this mischief," cried he,&lt;br /&gt;"Come, neighbours and friends, let us rally;&lt;br /&gt;If the cliff we will fence, we might almost dispense&lt;br /&gt;With the ambulance down in the valley."&lt;br /&gt;&lt;br /&gt;"Oh he's a fanatic," the others rejoined,&lt;br /&gt;"Dispense with the ambulance? Never!&lt;br /&gt;He'd dispense with all charities, too, if he could;&lt;br /&gt;No! No! We'll support them forever.&lt;br /&gt;Aren't we picking up folks just as fast as they fall?&lt;br /&gt;And shall this man dictate to us? The Metropolitan Police, as a corporate body, has been convicted at trial of endangering the health and safety of de Menezes. What the inquest will determine is whether or not de Menezes was unlawfully killed.&lt;br /&gt;&lt;br /&gt;According to the Guardian, Police Commissioner Sir Ian Blair's internal website message to Scotland Yard staff was leaked to the de Menezes family campaign:&lt;br /&gt;&lt;br /&gt;"Our approach will be one of humility. On 22nd July 2005, we confidently believed that our systems of command, of surveillance and of firearms intervention were among the best in the world. However, they failed in response to a previously unforeseen circumstance, suicide bombers on the run.&lt;br /&gt;&lt;br /&gt;"This will be a difficult couple of months and we must brace ourselves for criticism.&lt;br /&gt;I am certain that the amount of work we have done in the aftermath of the tragedy and the professionalism of the colleagues giving evidence will take us through the turbulence that lies ahead and it is to be hoped that one of the legacies of Jean Charles is a Metropolitan Police Service even better equipped to deal with tragedy and danger.&lt;br /&gt;&lt;br /&gt;"Finally, I am acutely conscious of the fact that the inquest will come on top of some serious challenges around race, within and outside the organisation. I am immensely proud that, despite the past few weeks, you continue to deliver a first-class service to all Londoners. You should stay proud too."&lt;br /&gt;&lt;br /&gt;During the inquest, the de Menezes' family representative Michael Mansfield asked Deputy Assistant Commissioner John McDowall if a tragedy such as this could ever happen again, and he responded: “I very much hope that this will never happen again. He performs his dangerous work despite suffering from epilepsy. &lt;br /&gt;&lt;br /&gt;His often illegal antics and his ability to scale just about any kind of building quickly earned him the nickname 'the human spider'.&lt;br /&gt;&lt;br /&gt;His terrifying brand of "free climbing" - climbing without tools or safety devices of any kind - has taken him up some of the most daunting buildings in the world, including the Sears Tower, Canary Wharf and the Eiffel Tower. Robert has been arrested countless times and admitted defeat only once – in Paris after the weather conditions made it too hot for him to continue, leading to him having to be rescued. Hayden's pal slipped while trekking on a school trip in southern Austria, and Hayden attempted to help him, falling to his death. &lt;br /&gt;&lt;br /&gt;Hayden, a 12-year-old school boy, died trying to save another child.&lt;br /&gt;&lt;br /&gt;Rewind to the death of Jordon Lyon, who drowned in May 2007 in a pond after trying to save his step-sister when they got into diffulties. Another child who died trying to save someone else. The subsequent inquest into the 10-year-old's death prompted calls to scrap Police Community Support Officers, as it revealed that they "just stood by and watched".&lt;br /&gt;&lt;br /&gt;So, if a small child is willing to risk his life to help another human being in distress, why didn't the PCSOs? Lack of training? The aim of the day is to get the average person who does unpaid overtime to just do their normal hours on this day and reflect on how well (or badly) they are balancing their life.&lt;br /&gt;&lt;br /&gt; &lt;br /&gt;Scarily, nearly five million people in the UK regularly do unpaid overtime, giving their employers an average £4,955 of free work a year. But it's not just about the money. As a health and safety professional you are undoubtedly aware that long hours are not good for us! &lt;br /&gt;&lt;br /&gt;Long working hours are bad for work-life balance, health, productivity and safety. In the UK we have reached epidemic levels. And overwork is definitely making us sick - a DTI survey found one in five men (19 per cent) had visited the doctor because of stress, rising to one quarter (23 per cent) of over 40s.&lt;br /&gt;&lt;br /&gt;I for one will certainly be taking advantage of the promotion to work my proper hours in the hope I will enter the weekend far less stressed than I usually do ... Forty-eight per cent are more likely to be bullied by clients and customers whereas over half of other age groups reported being bullied by their managers.&lt;br /&gt;&lt;br /&gt;Managing workplace bullying is an increasing challenge for employers. It is a serious health and safety issue that every employee and every company should be aware of. &lt;br /&gt;&lt;br /&gt;A good anti-bullying policy and some company-wide workshops are invaluable to ensure that everyone understands and gets the message.&lt;br /&gt;&lt;br /&gt;How do you manage workplace bullying? He was taken to hospital but later died.&lt;br /&gt;&lt;br /&gt;Nick Blundell, UCATT Regional Secretary for the Wales and South West, commented that this latest death underlines the dangerous nature of construction. "While it is alomost impossible to make the industry entirely safe, construction employers in general could be doing far more to make sites safer," he said.&lt;br /&gt;&lt;br /&gt;Do you work in construction? Although the Chinese government has introduced legislation aimed at cracking down on illegal or unsafe mines, mine owners and local officials are frequently accused of ignoring regulations in search of greater profits. &lt;br /&gt;&lt;br /&gt;China's industrial and economical advancements are amazing, however, its industrial safety seems to be severly lacking. But acceptable OSH standards in the working place are basic human rights. &lt;br /&gt;&lt;br /&gt;&lt;em&gt;What do other readers think? The only gripe I have been informed of is that some users are having difficulties logging in. Well, there's an easy way around that. It's always great to hear your views and my aim for 2008 is to build an online health and safety community that we can all be proud to be part of.&lt;br /&gt;&lt;br /&gt;At the end of last year there were calls to scrap Police Community Support Officers (PCSOs) following the death of a ten-year-old boy. Many readers had lots to say, as relayed in this very blog just last month. However, Geoff Lloyd, Deputy Chairman of the IIRSM Board of Governors, wrote to me recently with his view. Here is his letter in full.&lt;br /&gt;&lt;br /&gt;"As the retired Head of Safety for the Metropolitan Police I felt I had to raise some points to consider.&lt;br /&gt;&lt;br /&gt;"Firstly, the Health and Safety at Work, etc Act 1974 was not written with emergency services in mind, particularly section 3. In fact, police did not come under the umbrella of health and safety law until The Police (Health and Safety) Act 1997 was enacted. I know that the Metropolitan Police Service does not train its officers to carry out water rescues and officers are not required to swim.&lt;br /&gt;&lt;br /&gt;"Concerning the case of the two PCSOs, I understand that the officers did not just stand and watch the little boy drowning. When the officers arrived at the lake there was no sight of the boy in the water. Apparently some anglers who were sitting on the bank told the officers about it but had done nothing.&lt;br /&gt;&lt;br /&gt;"Perhaps we should also consider and ask where were the parents when this tragedy happened? Why had they let two small children play near water without supervision?&lt;br /&gt;&lt;br /&gt;"As I compose this letter, the radio news is reporting of a small child killed on the highway while riding a petrol 100cc-engine quad bike while following her father’s car at 7pm, in the dark, down an unlit country lane. Work-life balance and all that. Apparently, today is the most popular date in the calendar to call in sick - a staggering five million do so! I underestimated just how good it would feel when real-life users actually praise us mere journos for doing a great job and giving them what they need! It was fined £175,000 with £385,000 costs.&lt;br /&gt;&lt;br /&gt;The trial highlighted a catalogue of errors by police:&lt;br /&gt;&lt;br /&gt;&lt;ul&gt;&lt;li&gt;surveillance officers incorrectly identified de Menezes as the failed bomber who lived in the same block of flats;&lt;br /&gt;&lt;/li&gt;&lt;li&gt;senior officers deviated from the agreed plan on how to deal with the incident; and&lt;br /&gt;&lt;/li&gt;&lt;li&gt;firearms teams were poorly briefed and in the wrong locations.&lt;/li&gt;&lt;/ul&gt;After the verdict, presiding judge Mr Justice Henriques commented that this was very much an isolated breach brought about by quite extraordinary circumstances. The CPS used health and safety legislation after deciding there was insufficient evidence to charge officers with corporate manslaughter. Had this happened in 2008, do you think there would have been enough evidence to charge officers under the forthcoming Corporate Manslaughter Act? Post you views and tell the community. Meanwhile, lots of IIRSM Members got in touch with their opinions.&lt;br /&gt;&lt;br /&gt;IIRSM Member John Hill MIIRSM has worked in the health and safety industry for over 20 years, and has been somewhat taken aback at the “alacrity” with which the CPS decided that the de Menezes killing was a health and safety offence.&lt;br /&gt;&lt;br /&gt;“It seems clear that there has been a terrible hash made, the result of which was the death of an innocent man.&lt;br /&gt;&lt;br /&gt;“This, in my opinion, was the result of Prime Ministerial involvement when the last PM announced that he was to authorise "summary powers" for the police, which in some circumstances would justify a "shoot to kill" policy.&lt;br /&gt;&lt;br /&gt;“I am outraged that the health and safety law which I have been working to enforce for a long period of years should have been used as a political tool in order to avoid the uproar which would no doubt have erupted during the trial of police officers (and their superiors), for murder in a public place. It is clear that the decision to use H&amp;amp;S law was taken as a political way out to save political embarrassment.&lt;br /&gt;&lt;br /&gt;“Any law, including H&amp;amp;S law was not designed to prevent embarrassment to authority, but to ensure justice! The fact that EU law was also ignored makes the event even worse. For how can anyone have trust in the judicial system when (in my opinion), it was so blatantly misused in this case?”&lt;br /&gt;&lt;br /&gt;Many IIRSM members agreed with John, including Brian Cowan MIIRSM. He spent 25 years in the armed forces and has been a safety professional of 14 years. Brian admits he has mixed feelings on the case.&lt;br /&gt;&lt;br /&gt;“I know that the only way to stop a suicide bomber is to shoot him (or her) in the head and keep doing it until they lay down and become still. This may seem harsh but I assure you it is true. If the Met had failed to take this action and de Menezes had indeed been a bomber the resultant loss of life was potentially enormous.”&lt;br /&gt;&lt;br /&gt;Brian told me that he does recognise that the use of health and safety law and the subsequent successful prosecution proves beyond doubt that the letter of law was considered and the offence proven.&lt;br /&gt;&lt;br /&gt;“My end feeling is one of sadness,” continues Brian. “I wish that I could believe that the people who brought this prosecution remembered that policing and soldiering are not the same as working in a warehouse or on a construction site. Unfortunately I don't believe that.”&lt;br /&gt;&lt;br /&gt;Another member who wrote to me expressing their feelings on the case was Gordon Hartley FIIRSM. He finds it quite unacceptable that the Met can shoot a person seven times in the head. “What's the matter with shooting to disable?” he asks. “He should be paid off like the England Manager for doing a rubbish job!”&lt;br /&gt;&lt;br /&gt;So, should the officers have simply shot to disable, or were they right in their actions? We want to hear from you. But why has it taken a disaster such as yesterday’s, for the safety problems to be investigated? It seems that to get something done, they have waited until a major incident happens before we all stand up and take note and start to do something about it. That simply isn’t acceptable and I am sure many health and safety professionals will agree.&lt;br /&gt;&lt;br /&gt;Apparently the evacuation procedures worked like clockwork but surely they didn’t adhere to their risk assessment if the problem had been previously noted but not fixed? The HSE has launched an investigation so we’ll have to wait and see if anyone is prosecuted for the failures.&lt;br /&gt;&lt;br /&gt;Do you work in the North Sea’s offshore industry? For so long we have watched the Corporate Manslaughter and Corporate Homicide Act go backwards and forwards between the House of Commons and the House of Lords, it was most definitely a relief to learn the facts – and discuss the impact.&lt;br /&gt;&lt;/p&gt;&lt;p&gt;The event, held at the Hamilton House Hotel in London by the Centre for Corporate Accountability, was attended by leading figures in industry, and looked at the likely impact on private and public sector organisations and the way the new offence will be investigated and prosecuted. Also in attendance were representatives of bereaved families – giving delegates an insight into the devastating impact that health and safety failures can have.&lt;br /&gt;&lt;/p&gt;&lt;p&gt;Speakers included Lord McKenzie of Luton and the TUC’s outspoken general secretary, Brendan Barber. Mr Barber’s speech was certainly one that made my ears prick up. He mentioned last year’s 241 workplace fatalities, and also invited the audience to remember the 5,000 people killed last year because of asbestos exposure, the 1,000 killed in work-related road accidents, the many thousands killed by workplace cancers every year, as well as those who suffer heart attacks as a result of overwork or stress. He questioned why these deaths are not on the front of every national newspaper, why there aren’t more calls for action – and simply answered his own question: “I suppose it’s because we have become immune to it”.&lt;br /&gt;&lt;/p&gt;&lt;p&gt;Suspicious sounds from the audience seemed to agree. But we shouldn’t accept it ... and that is why the majority of the health and safety profession are in favour of the forthcoming Act, as I witnessed yesterday.&lt;br /&gt;&lt;/p&gt;&lt;p&gt;The enormous impact that the new legislation will have on business was discussed and the message of the day seemed to be: The prospect of limitless fines and the potential for huge damage to reputations mean that those responsible for health and safety need to get their houses in order before the Act comes into force.
